Terms of Service

By accessing or using ArtGeni (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify registered users of material changes by email.

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to: • Use the Service in any way that violates any applicable local, national, or international law or regulation • Upload images that you do not have the right to use or that infringe any third party's intellectual property rights • Upload images containing illegal content, including child sexual abuse material • Attempt to gain unauthorized access to any part of the Service or its related systems • Use automated tools to access the Service at a rate that exceeds reasonable human usage (unless you have API access under a Pro plan)

You retain all rights to images you upload. By uploading an image, you grant ArtGeni a limited, temporary license to process that image for the sole purpose of generating a prompt. This license expires immediately when the prompt is returned to you. We do not claim ownership over your images or generated prompts. Generated prompts are returned to you without restrictions on use.

You may not use ArtGeni to: • Generate prompts intended to produce harmful, violent, hateful, or sexually explicit content • Circumvent or bypass rate limits or access controls • Resell or sublicense access to the Service without our written permission • Scrape, crawl, or systematically extract data from the Service • Impersonate any person or entity or misrepresent your affiliation with any person or entity

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. If you wish to terminate your account, you may do so through your dashboard settings. Upon termination, your right to use the Service immediately ceases.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, IMAGE2PROMPT DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN NO EVENT SHALL IMAGE2PROMPT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ArtGeni is incorporated, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
